Hammer Creek Suppressor Legal Disclaimer
The purchase, ownership, and use of suppressors (silencers) manufactured by Hammer Creek are subject to strict federal, state, and local laws in the United States. The following disclaimer outlines important legal considerations and responsibilities:
Compliance with Federal Law:
Suppressors are regulated under the National Firearms Act (NFA) of 1934 and the Gun Control Act (GCA) of 1968.
To legally acquire a Hammer Creek suppressor, customers must: Submit ATF Form 4 (Application for Tax Paid Transfer and Registration of Firearm) through a licensed Federal Firearms Licensee (FFL) with a Special Occupational Taxpayer (SOT) designation. Pay the required $200 NFA tax stamp per suppressor. Pass a background check conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Await ATF approval, which may take several months. Suppressor orders that require a different FFL/SOT to intiate ATF form 4 submission, such as out-of-state purchases require an ATF form 3 that carries a 3 day approval period before transfer can take place.
State and Local Restrictions:
Suppressors are legal for civilian ownership in many states, but some jurisdictions prohibit or restrict their possession, use, or transport. It is the sole responsibility of the purchaser to verify and comply with all applicable state and local laws prior to ordering.
Hammer Creek does not ship to states or localities where suppressors are banned.
Intended Use:Hammer Creek suppressors are designed for lawful purposes, including recreational shooting, hunting (where permitted), and professional applications. Any use of our products for illegal activities is strictly prohibited and voids all warranties and liability on the part of Hammer Creek.
Transfer and Ownership: Suppressors may only be transferred to another individual or entity through an ATF-approved process via an FFL/SOT. Unauthorized transfer, sale, or possession is a violation of federal law and may result in severe penalties, including fines and imprisonment.
No Legal Advice:This disclaimer and information provided by Hammer Creek do not constitute legal advice. Customers are encouraged to consult with a qualified attorney or firearms expert to ensure full compliance with all relevant regulations.
Liability: Hammer Creek is not responsible for any misuse, improper installation, or illegal use of our suppressors. The purchaser assumes all risks and liabilities associated with ownership and operation. Products are sold "as is," subject to our warranty terms, and no guarantees are made regarding legal status in specific jurisdictions.
Export Restrictions:Exporting suppressors outside the United States is prohibited without proper authorization under the International Traffic in Arms Regulations (ITAR). Violation of export laws may result in criminal penalties. By purchasing or using a Hammer Creek suppressor, you acknowledge and agree to abide by all applicable laws and regulations. Failure to comply may result in the cancellation of your order, forfeiture of payment, and/or legal consequences enforced by the appropriate authorities. For questions about legal requirements, contact the ATF, your local FFL/SOT, or a legal professional.
